It seems he could face up to fifty years in prison. Whether that jail is civillian or military I know not, but fifty years should just be sentenced for the Bush-era leaks in 2009 (for some reason, everyone LOVED those)!

My grandfather says the Swedish man who operates WikiLeaks, and his cronies, should be tried for treason in the United States. I tryied to explain to him just how hard it IS to get a treason charge in this country, but if we can get one, it's be the WikiLeak owner's life. Treason is one of the few _federal_ crimes that end in death!

The Constituion is specific on treason:

"Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted."

Now, let's analyze WikiLeaks.

* "Levying War."
** Fortunately, WL isn't doing that in a literal sense.

* "Adhering to their Enemies; giving them Aid and Comfort."
** My interpretation of this clause is that you must both adhere AND aid/comfort the enemy. If you're stupid enough to support Bin Laden, that's not enough to be treasonous. Now, if said supporter provided funds, or arms, or information, etc., to Bin Laden because of his support, THEN it's treason.

* "Testimony of Two Witnesses on the same overt Act."
** There are thousands of witnesses in these cases that could give testimony that treason happened before a court of law. The men who operated that helicopter in that video, any head of the intelligence agencies violated, that chat room guy that caught Manning, WikiLeaks employees who plea bargained themselves to take out their leader, ect. ect. ect. ect.

* "Confession in Open Court."
** Dang, chat rooms aren't court, are they? :P

Even worse is that the man is foreign-born. The owner/founder/chief editor of WikiLeaks is NOT a United States resident or citizen. If we want to try him for treason, we'll need to get Sweden or his country of current residence to give him to us. Our country must do everything they can against this man, including extradition, to put him and his site away.

Transparency is a great thing, and we need more of it, but not like this. Military secrets should be leaked in peacetime, and decades after they happened. The CIA's Cold War mind-control experiements were leaked a little while back (and became a documentary), but that was after the USSR fell and after about forty years.

We haven't been able to catch Bin Laden in nine years since he attacked (I believe our closest to him was in the Clinton era in the early 1990s, with the footage and the declining to kill)... -and that is a mystery of its own. However, if we even WANT a remote shot at catching anyone in Al-Qaeda's ranks that aren't petty suicidal bombers, we need to stop those who leak war documents.

I would be quite pleased to see this man tried for treason and put to death. We are too soft on our enemies. Don't get me wrong, I'm not asking for carpet bombing or a sea of glass (we must protect innocent civillians), but if we don't become more agressive, this'll end up just like Vietnam.

If leaking data is as easy as Manning claims in the article, I am not paranoid if I worry what's next.TurtleShroomhttp://fanon.clubpenguinwiki.infonoreply@blogger.com
